En este complejo futuro que se nos predice, no solo se nos podrá superar en nuestras capacidades intelectuales o físicas, incorporando a nuestro entorno y a nuestro propio cuerpo un ingente aparataje tecnológico, sino que se nos podrá mejorar, y ello, incluso, antes de nacer, interviniendo directamente sobre el embrión. La naturaleza de lo humano se pone en cuestión, sobre todo, cuando la alteramos en su propia esencia, no solo en su entorno, y, además, desde su propio inicio. Se trata, (...) pues, de una disrupción y alteración sustancial ad intra del ser humano, no ad extra, como ocurre con la tecnología, aún cuando esta también tiene, obviamente, muchos efectos en el interior de aquél. Los cambios que se derivan de la Biotecnología y, concretamente, de la edición genómica, por un lado, ofrecen un enorme potencial para desarrollar nuevos conceptos, métodos y novedosas aplicaciones para los urgentes retos y necesidades de la sociedad. Por el otro lado, tales biotecnologías son percibidas como si tuvieran el potencial de desafiar y, a veces, desdibujar las actitudes, valores y modelos culturales de la propia sociedad. A tal reto no puede estar, obviamente, ajeno el Derecho en atención a los valores, intereses y derechos en conflicto. Si la pregunta que debemos nuevamente formularnos es qué es el hombre o qué es la naturaleza humana, el Derecho debe también ofrecer respuestas que permitan dar un sentido jurídico contemporáneo a tal esencia, preguntas que conectan directamente con el propio concepto jurídico de dignidad, no solo en cuanto valor ontológico del ser humano, sino también, recogiendo los términos explícitos del artículo 10.1 de nuestra Constitución, en cuanto fundamento del orden político y de la paz social. Otros organismos análogos han hecho intentos sobre el particular, pero el trabajo realizado por el Comité de Bioética de España es especialmente completo y profundo; un urgente llamado a un "ejercicio ejemplar de responsabilidad" para toda la sociedad y cada uno de sus miembros, incluyendo las autoridades públicas y los medios de comunicación. A la par con un decálogo de recomendaciones, el Comité envía un mensaje de esperanza sustentado en la capacidad que tenga la especie humana para mejorar individual y socialmente. The aim of this study consists of postulating an ethical approach to Human Rights conceiving them as rights of the other, claiming that this approach represent a starting point for the development of a legal pluralism that contributes to the achievement of an effective and authentic peace. For this study is based on the premise that the law must be able to deal with the serious and still pending social and environmental problems that underlie the violations of human rights, especially (...) those of ecological nature. By way of conclusion, the need for a radical change of the paradigm is evidenced, for which a perspective of ethics as a linguistic praxis is proposed, since such praxis has the potential to inspire the reformulation of human rights, for the purpose of reversing the dynamics of violence imposed by the logic of identity underlying the current legal system. IntroductionPreoperative neurocognitive disorder is a common condition affecting 14–51. 7% of the elderly population. General anesthesia has already been associated with the one-year post-operative neurocognitive disorder, specifically, a deficit in executive function, measured by the Trail Making Test B, but its long-term effects on cognitive function have not been investigated. We aimed to detect preO-NCD prevalence in patients scheduled for cardiac surgery and further investigate the possible role of previous general anesthesia in general preoperative cognitive status [measured via the Montreal (...) Cognitive Assessment ] and/or in executive functioning.MethodsIn this observational, prospective study, 151 adult patients scheduled for elective cardiac surgery underwent MoCA and TMT-B. Data on age, education, pGA, comorbidities, and laboratory results were collected.ResultsWe discovered a general cognitive function impairment of 79.5% and an executive function impairment of 22%. Aging is associated with an increased likelihood and education with a decreased likelihood of general cognitive impairment, but only education was significantly associated with a decreased likelihood of executive function impairment. While pGA did not significantly affect preO-NCD, a noteworthy interaction between aging and pGA was found, resulting in a synergistic effect, increasing the likelihood of executive function impairment.ConclusionWe found a high prevalence of preO-NCD in patients scheduled for cardiac surgery. General cognitive function impairment is highly associated with advancing age. However, older patients with at least one pGA appeared to be at an increased risk of preO-NCD, especially executive function impairment, suggesting that TMT-B should be associated with MoCA in the preoperative cognitive evaluation in this population. This study investigates how e-business capabilities and digital marketing strategies jointly influence business performance in the e-commerce industry, which has experienced unprecedented growth driven by technological advancements and changing consumer behavior. E-business capabilities encompass the use of technology and digital infrastructure, while digital marketing strategies are employed to attract and retain online customers. The study examines the effect of e-business capabilities through digital marketing strategies on the customer satisfaction and loyalty of UAE e-commerce industry. The research is descriptive and explanatory, (...) and uses a structured 5-scale Likert questionnaire to collect data from the HR managers of 135 e-commerce companies based in UAE. The statistical analysis is performed using structural equation modeling. The findings highlight the significant relationship of the study variables. Consequently, the results of this study provide valuable insights for e-commerce businesses, elucidating the need to invest in robust e-business capabilities to support effective digital marketing efforts. Additionally, the research underscores the significance of tailoring digital marketing strategies to align with specific business objectives and customer segments. The study also contributes to the literature on digital transformation, by demonstrating how e-business capabilities and digital marketing strategies can enable e-commerce firms to adapt and thrive in the dynamic and competitive digital environment. Quantum indistinguishability directly relates to the philosophical debate on the notions of identity and individuality. They are crucial for our understanding of multipartite quantum systems. Furthermore, the correct interpretation of this feature of quantum theory has implications that transcend fundamental science and philosophy, given that quantum indistinguishability is a resource in quantum information theory. Most of the conceptual analysis of quantum indistinguishability is restricted to studying the permutational invariance of quantum states, the concomitant quantum statistics and their entanglement. Here, we (...) analyse the role of indistinguishability and non-individuality in other areas of quantum theory. We start by analysing how a very peculiar use of indistinguishability underlies Feynman’s rules for summing amplitudes in interference phenomena. Next, we study how quantum indistinguishability is underestimated in several topics of debate in the quantum physics literature, such as the Einstein–Podolsky–Rosen argument, Bell’s inequalities and the Bell–Kochen–Specker theorem. Finally, we argue that an ontology of truly indistinguishable entities can serve as a basis for a quantum ontology that can give interesting answers to the interpretational problems of quantum mechanics. We claim that, in addition to superposition, contextuality and entanglement, indistinguishability (understood in a robust ontological sense) is one of the central features of quantum physics. -/- . Objective of the study: To analyze the costs and profits of sugarcane production regarding the cultural practices of sugarcane suppliers. Methodology/approach: This study positions itself in this gap by comparatively analyzing 6 types of cultural practices: unraveling, windrowing, application of correctives, herbicides, insecticides and fertilizers, with the option of two systems Fixed rate (TF) and Variable rate (TV). Originality/Relevance: Brazil is a world reference in sugarcane production, with the State of São Paulo being the largest Brazilian producer. However, for sugarcane (...) suppliers to maintain this activity there is a need to reduce production costs and increase profitability/ha. However, there is a theoretical-practical gap in the financial assessment (costs and profits) of different cultural practices inherent to sugarcane production. Main results: The results demonstrated that the costs of cultural practices represent more than 30% of the total sugarcane production costs. The TF system proved to be more cost-efficient in the following operations: correctives, herbicides and insecticides. In the application of fertilizers, the TV system, in broadcast mode, had the best result. Finally, the profit/ton was R$1.70, demonstrating a very low profit margin/ha given the risk of the activity. Theoretical/methodological contributions: The sample for this research comprised 55 sugarcane suppliers from the State of São Paulo, whose data were obtained through a survey. The comparative analysis was based on the difference in costs of cultural practices and the estimation of the level of certainty (profit/costs), analyzed through the cumulative frequency carried out through the Monte Carlo Simulation (SMC). In this work, we discuss a formal way of dealing with the properties of contextual systems. Our approach is to assume that properties describing the same physical quantity, but belonging to different measurement contexts, are indistinguishable in a strong sense. To construct the formal theoretical structure, we develop a description using quasi-set theory, which is a set-theoretical framework built to describe collections of elements that violate Leibnitz's principle of identity of indiscernibles. El objetivo de este artículo es hacer una reconstrucción racional del uso del examen de proporcionalidad en contextos de adjudicación judicial de derechos sociales constitucionales. Dicho trabajo de reconstrucción será desarrollado en dos pasos. En primer lugar, se tratará el interrogante referido a si el examen de proporcionalidad en su variante “por omisión” exhibe o no una estructura diferente con respecto a su, mucho más conocida e investigada, variante “por exceso”. It is well known that in quantum mechanics we cannot always define consistently properties that are context independent. Many approaches exist to describe contextual properties, such as Contextuality by Default, sheaf theory, topos theory, and non-standard or signed probabilities. In this paper we propose a treatment of contextual properties that is specific to quantum mechanics, as it relies on the relationship between contextuality and indistinguishability. In particular, we propose that if we assume the ontological thesis that quantum particles or properties (...) can be indistinguishable yet different, no contradiction arising from a Kochen-Specker-type argument appears: when we repeat an experiment, we are in reality performing an experiment measuring a property that is indistinguishable from the first, but not the same. We will discuss how the consequences of this move may help us understand quantum contextuality. (shrink)

Tomando en cuenta el desarrollo de la lógica cuántica convexa, presentamos un análisis de la estructura formal de la teoría que, argumentaremos, debe ser considerado a la hora de desarrollar un nuevo esquema conceptual para la interpretación de las mezclas cuánticas. We discuss the problem of compound systems in the context of quantum logic as well as the interpretation of improper mixtures. Taking into account the development of convex quantum logic, we present an analysis of the formal structure of the theory which we will argue, must be taken into account when developing a new conceptual scheme for the interpretation of quantum mixtures. Este trabajo busca responder al siguiente interrogante: ¿es posible resolver confl ictos entre normas constitucionales que disponen derechos fundamentales sin necesidad de ponderar? Para ello expondremos la teoría que, para los casos de confl ictos constitucionales de derechos, propone reconstruir sistemas normativos. Esta teoría está representada en los trabajos de Moreso, Mendonca y Martínez Zorrilla y se presenta como una alternativa a la ponderación. Concluiremos que, si bien esta teoría puede resultar un buen complemento a la hora de formalizar las (...) decisiones judiciales sobre asuntos constitucionales, no puede reemplazar de plano a la ponderación, pues ésta siempre subyacería latente. Ello puede vislumbrarse con claridad en los casos donde derechos sociales fundamentales pretenden validez, en cuyo contexto la ponderación se presenta como algo conceptualmente necesario. (shrink)

The purpose of this article is to make a rational reconstruction of the use of the proportionality test in contexts of judicial adjudication of constitutional social rights. This reconstruction will be developed in two stages. Firstly, I will deal with the question of whether the proportionality test in its variation by omission (that is, in cases of positive rights) exhibits or not a different structure with respect to its (better known and developed) variation by excess (that is, in cases of (...) negative rights). Secondly, I will describe the rules and forms of argumentation implied in the use of the proportionality test by omission, which constitute its respective sub-tests of suitability, necessity and proportionality stricto sensu. Ahora que tan familiarizados andamos con el término crisis, suele olvidarse que hace ya bastantes años, y desde presupuestos ecológicos, veníamos hablando de otra crisis, la ambiental, si bien la experiencia ha demostrado que no estaban tan lejanas, ni en el tiempo, ni en el origen: el medio ambiente y sus alteraciones no son sino un formidable indicador del modelo económico que subyace.

The costs of agricultural inputs added to those of labor represent almost a third of the total cost of Brazilian sugarcane production. This study analyzes the behavior of the price per ton of sugarcane in Brazil, relating it to the main production costs of this cultivation. Twelve price indicators from January 2015 to December 2020 were evaluated. First, the data were adjusted to a multiple linear regression model to identify the significant variables on variation in the price per ton of (...) sugarcane. Then, the Monte Carlo simulation was used to measure the level of certainty of occurrence of these variables, and forecasts were obtained from the adjustment of ARIMA models. The results showed the influence of the costs of diesel oil, two agricultural pesticides, and daily laborers on the price of sugarcane, besides an increasing trend of its, providing relevant short-term projections for decision-making about investments in the agribusiness sector. Kit Fine’s contribution to logic is vast and diverse; the chapters in this book deal with a significant part of it. In this introductory chapter, we clarify and contextualize the main themes of Fine’s work that are centre stage in this book, after which we give a summary of each chapter.

This book explores some of Kit Fine's outstanding contributions to logic, philosophy of language, philosophy of mathematics, and metaphysics, among others. Contributing authors address in-depth issues about truthmaker semantics, counterfactual conditionals, grounding, vagueness, non-classical consequence relations, and arbitrary objects, offering critical reflections and novel research contributions. Each chapter is accompanied by an extensive commentary, in which Kit Fine offers detailed responses to the ideas and themes raised by the contributors. The book includes a brief autobiography and exhaustive list of his (...) publications to this date. This book is of interest to logicians of all stripes and to analytic philosophers more generally. While climate represents a rather stable (if evolving) cycle of recurring conditions, atmospheric events are fleeting and less predictable. Equally, architectural spaces can establish a general climatic scaffolding that increases the possibility (...) of particular atmospheres to unfold, without however evolving into a deterministic cause-effect relationship. By addressing and comparing philosophical notions and architectural questions, I intend to formulate a novel theorisation as a useful tool for both criticism and design. (shrink)

Non-well-founded trees are used in mathematics and computer science, for modelling non-well-founded sets, as well as non-terminating processes or infinite data structures. Categorically, they arise as final coalgebras for polynomial endofunctors, which we call M-types. We derive existence results for M-types in locally cartesian closed pretoposes with a natural numbers object, using their internal logic. These are then used to prove stability of such categories with M-types under various topos-theoretic constructions; namely, slicing, formation of coalgebras , and sheaves for an (...) internal site. The paper uses the formalism of indexed categories to recover the proof of a standard final coalgebra theorem, thus showing existence of final coalgebras for a special class of functors on finitely complete and cocomplete categories. As an instance of this result, we build the final coalgebra for the powerclass functor, in the context of a Heyting pretopos with a class of small maps. This is then proved to provide models for various non-well-founded set theories, depending on the chosen axiomatisation (...) for the class of small maps. (shrink)

In a very short article, James Sterba argues that there is a moral duty to sacrifice one’s life to save the lives of others. Sterba justifies this duty by drawing an analogy with a series of cases in which some degree of sacrifice would be commonly accepted for the benefit of third parties. In this paper, I argue that Sterba’s argument reaches the correct conclusion, but is invalid. In addition, I point out two different arguments to support the existence of (...) a duty to sacrifice one’s life to save the lives of others. (shrink)

In this paper I will evaluate the normative assumptions of Nozick's experience machine. I try to show that the intrinsic value that experiment gives to objectivity should be rejected from utilitarianism and that subjectivity counts as a necessary and sufficient condition for moral evaluation. I also conclude that satisfaction preferences utilitarianism to stay within the boundaries of utilitarianism should be considered as broad mental states consequentialism.
